Terms of Service

These terms govern the use of Cutstack (the “Service”), provided by [LEGAL ENTITY], [REGISTERED ADDRESS], VAT [VAT NUMBER] (“we”, “us”). By creating an account or using the Service you agree to them. If you use the Service on behalf of a business, you confirm you may bind that business.

1. What the Service is

Cutstack removes the background from product photos in batches, checks each result automatically, lets you edit results together, and exports them in the size and format you choose. It runs in the browser; nothing is installed. The Service does not include an API or integrations. If we add them, they will be offered separately.

2. Accounts

  • You need an account (Google or e-mail and password) to process photos. Keep your credentials to yourself; what happens under your account is yours.
  • One person, one account. New accounts receive 20 welcome credits once; creating accounts to collect welcome credits repeatedly is not allowed.
  • You must be 18 or older, or of the age of majority where you live.
  • You can delete your account at any time from the account menu. Remaining credits are not refunded (see the refund policy).

3. Credits

  • 1 credit = 1 photo that finishes with a usable result. Credits are reserved when a batch starts and charged only for photos that come out clean.
  • Editing a result (size, background, position, upscale, tone) is free. Re-running the AI on a photo (“retry”) costs one credit.
  • Failed photos, results our automatic check marks as clearly broken, and reports we verify are refunded automatically. Details in the refund policy.
  • Bought credits do not expire while your account exists. Plan credits from a marketplace licence refresh monthly and roll over up to three months’ worth.
  • Credits are personal to the account, are not money, and cannot be transferred, resold or exchanged for cash.

4. Purchases and marketplace licences

  • Credit packs are one-off purchases at the price shown at checkout, taxes included where applicable. Prices may change; a change never affects credits already bought.
  • Licences bought on a marketplace (for example AppSumo) are governed by the marketplace’s terms for payment and refunds and by these terms for use. A licence gives lifetime access to the features of the Service and a monthly photo allowance, as described on the marketplace listing. It does not include an API, resale or white-labelling.
  • We may adjust allowances or limits with at least 30 days’ notice by e-mail.

5. Your photos

  • You keep every right to the photos you upload and to the results. You give us only the permission needed to process them and show them back to you.
  • You confirm you have the right to use the photos you upload. Do not upload content that is illegal, infringes someone’s rights, or shows people without their consent.
  • Photos are processed on our servers in the EU; the AI model runs on a managed cloud provider, which receives the photo for processing only. We do not use your photos to train anything.
  • Results are temporary. A batch and everything in it are deleted about two hours after it finishes. Download what you need before then. We are not a storage service.

6. Fair use

Limits apply to keep the Service working for everyone: 200 photos per batch, 25 MB per photo, 100 MB per ZIP, and rate limits on requests. Do not attempt to circumvent them, scrape the Service, or interfere with its operation. We may suspend accounts that do.

7. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted operation. We may change or discontinue features; if we discontinue the Service, we will give reasonable notice and, for unused bought credits, a refund.

8. Warranty and liability

The Service is provided as is. Background removal is automatic and not every result will be usable; that is what the automatic refund is for. To the extent the law allows, our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for consumers under mandatory consumer protection rules.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or close accounts that breach these terms, after notice where reasonable. On closure, unused credits are forfeited except where the refund policy says otherwise.

10. Law and disputes

These terms are governed by the laws of [COUNTRY]. Disputes go to the courts of [COURT OF JURISDICTION], without prejudice to mandatory consumer rights in your country of residence. EU consumers may also use the European Commission’s online dispute resolution platform.
